What changed with the 2025 reform
Italian Law 74/2025 modified the transmission of citizenship to minors born abroad. Since May 24, 2025, not all children of Italian citizens born outside Italy automatically acquire citizenship: first it is necessary to identify whether citizenship from birth or acquisition by benefit of law corresponds.
Ordinary route: citizenship from birth
Ordinary transcription may apply when a condition provided for by the new law is met, for example, if a parent or grandparent had exclusively Italian citizenship at the relevant time, or if the Italian parent legally resided in Italy for at least two continuous years after acquiring citizenship and before birth. The Embassy evaluates the case and may request additional evidence.
Legal benefit for those born after May 24, 2025
When the minor is not Italian from birth, an Italian parent by birth can transmit citizenship to him or her by means of a declaration of will. Both parents, including the foreign parent, must normally declare within one year of the birth or subsequent determination of parentage. Citizenship takes effect from the day following the complete declaration.
Transitional regime until May 31, 2029
Minors who had not turned 18 on May 24, 2025 can benefit from the transitional regime if the parent was recognized as Italian through an administrative or judicial request submitted within the legal period indicated by the Embassy. The declaration must be submitted by 23:59 Rome time on May 31, 2029.
Documentation requested in Lima
The official list includes reservation at Prenot@mi, transcript request, declaration forms, personal file, identity documents and original birth certificate. The record must be apostilled, translated into Italian by a sworn public translator or certified collegiate translator and the translation must also be apostilled. The Embassy requests a notarized certificate of residence in the consular district, apostilled, translated and with the translation apostilled.
Age of games
For this procedure it is advisable to request recent items. Some consular and citizenship procedures require certificates issued within the previous six months; The specific page for minor children must prevail when it indicates a different validity. Before apostilling and translating, confirm the issue date accepted by the Embassy.
