Why you should register in Italy
The divorce obtained in Peru must be communicated to update the Italian civil status. The Italian citizen residing abroad submits the file to the competent Embassy or Commune.
Court ruling
The process ends with a ruling from the Judiciary. For Italy, a complete and final or agreed sentence is required, with identification of the parties and a decision on the dissolution of the marriage.
Firmness and annotated record
If finality does not expressly appear, a resolution may be required declaring the sentence consented or enforceable. The Embassy can also request a marriage certificate with a marginal note of divorce.
Apostille and translation into Italian
The Embassy requests that the Peruvian sentence or definitive document be apostilled, translated into Italian by an official or certified translator and that the translation be apostilled again. The same chain is applied to the recorded marriage certificate when necessary.
Form and presentation
The file includes the instance of recognition of foreign divorce published by the Embassy. Check names, dates, file number, annotations and matches with Italian records before submitting. The Embassy or the Commune decides the recognition in accordance with Italian Law 218/1995.
